Subject: Architectural Review Committee Approval Process

Dear Homeowner:

As we continue to personalize our homes, the board would like to take a minute to remind everyone that Colter Commons is a planned development bound by Covenants, Conditions and Restrictions, also known as CC& R’s.

Items That Require Approval

The CC& R’s for Colter Commons specifically state that any modifications to the outside of your home require approval by the Architectural Review Committee. These include, but are not limited to:

  • Addition or modification of any walkway (includes stamping or staining)
  • Addition or modification of driveway (includes stamping or staining)
  • Addition of any hardscape, stone or concrete, including courtyards and fountains
  • Modifications to the original architectural appearance of the home, including color scheme
The CC& R’s for Colter Commons also stipulate the requirement for approval of anything in the back or side yards of a residence that is within view of the community. These include, but are not limited to:

  • Basketball Goals and Backboards
  • Sports Lights
  • Sheds
  • Playground Equipment
  • Patio Covers, Pergolas and Arbors
  • Pool, Spa and Outdoor Fireplace features that project above the fence line
  • Recreational Vehicle Parking
Items That Do Not Require Approval

The Board of Directors and the Architectural Review Committee have adopted a list of pre-approved landscaping that can be added to the front, side or rear yard of a residence without ARC approval. Any modifications not on this pre-approved list will require the usual Architectural Review application for approval. As always, proper maintenance of landscaping is required. In addition, as permitted by the Association Documents, the Board has decided to specifically allow the following items without Architectural Review approval:

  • Potted plants (in good condition and maintenance)
  • Decorative flowers (seasonal or annual)
  • Small flagpoles that are attached to the house
  • Patio Furniture
Below are the steps that need to be taken in order to receive approval to alter the outward appearance of your home.
  • Please visit http://www.coltercommons.com to obtain the following items
    • Application for Design Review
    • Pre-Approved Landscaping List
    • Miscellaneous Home Owner Information

  • Submit an Application for Design Review requesting the particular change to the exterior of your unit. This form is available at the Colter Commons Website or may be obtained from Kinney Management Services by calling (480) 820-3451 or by fax at (480) 820-7441. Completed applications can be faxed or may be returned to the address below.

  • 3. With the request please include a current and colored picture of the change (if applicable). Please also include a detailed drawing of the change that you are requesting to be made. On this request please provide a timeline of when the changes will be started and completed. Note: All modifications must be completed within six (6) months, or the application will expire. A new application will then need to be submitted.

Once all of these steps are taken, please submit and wait to hear back from the architectural committee before proceeding with your project. Efforts to make a decision or request for further information will be made as soon as possible, but may take up to forty-five (45) days.
